P&DG have obtained a Certificate of Lawfulness for a large detached dwelling in the Derbyshire Countryside, surrounding by hectares of woodland. Planning permission was originally granted for the dwelling for a forestry worker and restricted by condition to persons working in agriculture or forestry. Following the death of the owners, the heirs provided evidence that the occupiers had not been actively engaged in forestry and had other employment from original occupation. We successfully argued that in these circumstances the original permission had never been lawfully implemented. In demonstrating that the house had been occupied for over four years, the dwelling had become lawful and is not tied to any of the original conditions or a planning obligation which prevented the splitting up of the house and woodland. The grant of the certificate ensures a significant uplift in value for the property.
